Terms of Use

These Terms of Use (“Terms”) govern your use of the Miraaj app, alongside Apple’s Licensed Application End User License Agreement, which governs the licence itself. Please read them. By downloading or using the App, you accept these Terms.

Miraaj (the “App”) is operated by Erdinc Dikici (“we,” “us,” or “our”).

1. License

We grant you a personal, non-transferable, non-exclusive, revocable license to use the App on Apple devices that you own or control, in accordance with the App Store Terms of Service and Apple’s Licensed Application End User License Agreement. Where those Apple terms and these Terms conflict regarding the App Store, Apple’s terms govern for App Store matters.

2. Miraaj Premium & subscriptions

The App offers an optional upgrade, Miraaj Premium, which unlocks additional depth, personalization, and convenience features. Premium is offered as:

Auto-renewal terms

Refunds are handled by Apple in accordance with App Store policy; we cannot issue App Store refunds directly. Restore previous purchases at any time using “Restore Purchases” in the App.

3. Nature of the content

A companion, not an authority. Miraaj is a tool for personal worship, reflection, and study. It does not replace the guidance of qualified scholars.

Prayer times and Qibla direction are calculated estimates based on your location and the method you select; verify them locally when precision matters. Contemplative features such as Cifr (ʿIlm al-Jafr) and “Open to Reflection” are offered as traditions of contemplation — not as predictions of the future or religious rulings.

The App’s name, design, original text, artwork, and software are owned by us or our licensors and are protected by intellectual-property laws. Sacred scripture and classical works are reproduced for devotional and educational use; public-domain texts are presented faithfully and attributed where applicable. Your license to use the App does not transfer ownership of any content to you.

6. Disclaimers

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that calculated times will be free of inaccuracies.

7. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of or inability to use the App. Where liability cannot be excluded, it is limited to the amount you paid for the App in the twelve months preceding the claim.

8. Changes to the App and these Terms

We may modify or discontinue features of the App, and we may update these Terms from time to time. Material changes will be reflected here with a new “Last updated” date. Continued use after a change means you accept the revised Terms.

9. Governing law

These Terms are governed by, and construed in accordance with, the applicable laws of the jurisdiction in which we operate, without regard to conflict-of-law principles. Nothing in these Terms limits any mandatory consumer-protection rights you may have under the law of your country of residence.

10. Apple as third-party beneficiary

You acknowledge that these Terms are between you and us, not with Apple. Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Any maintenance, support, or product-liability claims should be directed to us, subject to applicable law and the Apple terms referenced above.

Bu Kullanım Koşulları (“Koşullar”), Apple’ın Lisanslı Uygulama Son Kullanıcı Lisans Sözleşmesi’yle birlikte, Miraaj uygulamasının kullanımını düzenler; lisansın kendisini Apple’ın sözleşmesi düzenler. Lütfen oku. Uygulamayı indirerek veya kullanarak bu Koşulları kabul etmiş olursun.

1. Lisans

Bir yoldaş, bir merci değil. Miraaj; kişisel ibadet, tefekkür ve çalışma için bir araçtır. Ehil âlimlerin rehberliğinin yerini tutmaz.

Namaz vakitleri ve kıble yönü, konumuna ve seçtiğin yönteme dayanan hesaplanmış tahminlerdir; kesinlik gerektiğinde yerel olarak doğrula. Cifr (İlm-i Cefr) ve “Tefekküre Aç” gibi tefekkür özellikleri birer tefekkür geleneği olarak sunulur — geleceğe dair kehanet ya da dinî hüküm değildir.

Uygulamanın adı, tasarımı, özgün metinleri, görselleri ve yazılımı bize ya da lisans verenlerimize aittir ve fikrî mülkiyet kanunlarıyla korunur. Mukaddes metinler ve klasik eserler ibadet ve eğitim amacıyla kullanılmıştır; kamuya mal olmuş metinler sadakatle sunulmuş ve gereken yerde kaynağı belirtilmiştir. Uygulamayı kullanma lisansın, herhangi bir içeriğin mülkiyetini sana devretmez.

6. Sorumluluk reddi

Uygulama, kanunun izin verdiği azami ölçüde, açık ya da zımnî hiçbir garanti verilmeksizin — belirli bir amaca uygunluk ve ihlal etmeme dâhil — “olduğu gibi” ve “mevcut hâliyle” sunulur. Uygulamanın kesintisiz veya hatasız çalışacağını, hesaplanan vakitlerin yanlışlık içermeyeceğini taahhüt etmiyoruz.

7. Sorumluluğun sınırlandırılması

Kanunun izin verdiği azami ölçüde; dolaylı, arızi, özel, netice kabîlinden veya cezai hiçbir zarardan, ya da Uygulamayı kullanmandan veya kullanamamandan doğan hiçbir kayıptan sorumlu olmayacağız. Sorumluluğun tamamen kaldırılamadığı hâllerde, sorumluluk talebin öncesindeki on iki ay içinde Uygulama için ödediğin tutarla sınırlıdır.

8. Uygulamadaki ve bu Koşullardaki değişiklikler

Uygulamanın özelliklerini değiştirebilir ya da sonlandırabiliriz; bu Koşulları da zaman zaman güncelleyebiliriz. Esaslı değişiklikler, yeni bir “Son güncelleme” tarihiyle burada yansıtılır. Değişiklikten sonra kullanmaya devam etmen, güncellenmiş Koşulları kabul ettiğin anlamına gelir.

9. Uygulanacak hukuk

Bu Koşullar, faaliyet gösterdiğimiz yargı çevresinin yürürlükteki hukukuna tabidir ve ona göre yorumlanır; kanunlar ihtilâfı kuralları uygulanmaz. Bu Koşullardaki hiçbir hüküm, ikamet ettiğin ülkenin hukukundan doğan emredici tüketici haklarını sınırlamaz.

10. Üçüncü taraf lehtar olarak Apple

Bu Koşulların Apple ile değil, seninle bizim aramızda olduğunu kabul edersin. Apple, Uygulamadan ya da içeriğinden sorumlu değildir. Apple ve iştirakleri bu Koşulların üçüncü taraf lehtarlarıdır ve Koşulları uygulatabilirler. Bakım, destek veya ürün sorumluluğuna ilişkin talepler, yürürlükteki hukuka ve yukarıda anılan Apple şartlarına tabi olmak üzere bize yöneltilmelidir.
